Terms and Conditions for Tours
The Terms and Conditions below are for bookings of our Tours (Trips/Excursion) in Kenya which are
organised and advertised on our websites, social media handles or via authorized Agents.
1. Our Services
a. We provide Tours which are also referred to as a Trips. A Tour maybe defined as a travelling for
pleasure and includes a visit to specific places listed in the itinerary.
b. The itinerary of each Trip may be presented to the Client at the time of booking. Should the activities
change, Sylgam travels will inform the Customer and seek their consent.
2. Age and Identity of Customer
a. Sylgam Travels cannot accept bookings from any person who is below the Age of 18. By accepting
this Agreement, the Customs assures that he/she is at least 18 years before the day this Tour is
b. As an exception to (a.) above Parents may book on behalf of their kids and accompany them for
the duration of the entire Tour.
c. As a further exception, persons between the ages of 15 – 17 may join our Trips without the company
of their Parents, if the Parents give a written consent (incl. email, SMS) in that regard prior to the
Departure of the Trip. In this case, Parents should carry out the Trip Booking process themselves
and communicate this clearly to Sylgam in good time before the departure of the Tour. Parents
should also give consent regarding the participation of the Child in the Activities planned for the
particular Tour.
3. Payments
a. For multi-day (more than 1 day) Tours booked 60 days in advance, a deposit of 25% of the Tour
Rate (charge) is due upon confirmation and full payment is due 30 days before the Tour. For Tours
booked less than 60 days in advance the following deposit and payment schedule shall apply.

b. For day Tours, full payment is due upon booking.
c. All payments should be made in Kenyan Shillings for Clients resident in Kenya and United States
Dollars (USD) for clients not resident in Kenya. The exchange rate for USD payments should
correspond to Indicative rates available on the website of the Central Bank of Kenya (CBK) on the
day of booking by the Client.
d. All Payments are to be made through one of the options below:

e. The Client is entitled to an invoice upon confirmation, on booking and 60 days after the Tour.

f. Any refunds due to cancellation of the Tour will be paid through the method of payment used during
booking. This is subject to any credit card, bank transfer or mobile money fees.
4. Cancellations and Amendments
a. Cancelation by the Client: In the event of inability of the Client to take part in a booked tour it is
advisable that the Client informs Sylgam Travels as early as possible. A full schedule of refunds to
be made if the Client cancels, is provided below:

This schedule applies only to multi-day Tours. Refund amounts stated above may be reduced if
penalties are charged by third parties such as Hotels, Restaurants, Car Rentals and other entities
with which separate bookings were made on behalf of the client.
b. In Cases such as National emergencies, weather emergencies and other events recognised by law,
Sylgam Travels may cancel the Tour or replace the itinerary with the consent of the Client.
c. In the event of an agreement by Sylgam travels and the Client to discontinue the Tour due to events
in (4b.) above a full refund shall be made to the Client. This is subject to fees charged by third party
suppliers such as Hotels, Restaurants, Car Rentals and fees charged due to the payment method
d. In the event of a cancellation, the Client reserves the right to transfer the funds to another Tour
provided by Sylgam Travels.
5. Communication and confirmations
a. Booking Confirmation and Invoices will be sent only from official Sylgam emails:

b. Communication with our Agents/Consultants/Representatives are binding only when carried out
through their official emails with“@sylgam.com” endings; through our Social Media handles
(Facebook – “Sylgam”, Twitter – “Sylgam_Tours” & Instagram – “sylgam_tours”); or through the
Mobile Phone numbers shared through any of the means named above.
6. Travel insurance and other Covers
a. The Rates/Price/Fees charged for the Tour does not include Travel insurance. Clients are advised
to purchase Insurance from authorized Insurance firms.
b. Sylgam Travels Kenya does not issue Visa, Identification documents or other legal travel
certificates. The Client holds responsibility for the acquisition of Visas and valid government issued
identification documents.
7. Limitation of liability
a. Sylgam Travels Kenya is not responsible for the acts or failures to act, wilfully or otherwise, of its
suppliers, or of any other third party over whom Sylgam Travels Kenya has no control.
b. Sylgam Travels Kenya is not liable for any bodily injury or harm, accidents, property damage or
personal loss as a result of, but not limited to: physical exertion for which the participant was not
prepared; travel by plane, train car, bus, boat or other mode of transportation (such as bicycle,
horse, foot, kayak, etc.); consumption of alcoholic beverages; high altitude; forces of nature, such
as high winds, hurricanes, flooding, etc.; heat exhaustion, equipment failure; civil unrest or terrorism;
or the availability of medical services in remote areas and the quality thereof.

c. Sylgam Travels Kenya is not responsible for costs incurred by the Client while preparing for the
Tour such as Air tickets, commute to announced pick up venue etc. The Client is also fully
responsible for expenses not included in the price of the Tour.
d. Sylgam Travels Kenya is not liable for lost of property, be it before, during and/or after the execution
of its trips. Clients are highly requested to safeguard their property and to demonstrate utmost
respect for property and person of mutual travellers on any of its trips.
e. The Client is fully liable for his/her engagement in acts that are forbidden under the law, but which
occur while they are participating in a Tour. These acts include but are not limited to purchase of
illegal services, consumption of illegal substances and acts of violence.
8. Jurisdiction
a. These Terms and Conditions are governed by the laws of the Republic of Kenya where Sylgam
Travels Kenya is a registered company.
b. The Terms and Conditions apply at all times in all places where Sylgam Travels Kenya operates,
including, but not limited to countries from the East African Community and other African countries.
c. Clients agree to abide by all laws applicable to places and countries in which Sylgam Travel
d. Sylgam Travels Kenya will do whatever is in its power to communicate changes in government
policy such admission and fees at Tourist points.
9. Photography and Videos
a. Clients who do not wish to appear in group photos or videos taken during a Tour may inform the
Guide of their preference at the departure of the Tour.
b. Group photos and videos taken during Tours may be used by Sylgam and can be requested by
clients who appear in such photos or videos.
10. General Conduct on Tours
a. Notwithstanding the above, Clients are requested to conduct themselves in a considerate, matured
and respectful manner throughout the entire Trip.
b. The Client agrees to respect and uphold the Privacy and Personal Preference of All individuals
traveling with the Group, irrespective of age, gender, physical or psycho-social disability, race,
ethnicity, religion, or creed of such a person.
c. Punctuality and self-discipline are required from Clients to allow the smooth carrying out of the
Activities as indicated in the itinerary of the Tour.
11. Declaration
I (fullname) ………….………………………………… herewith declare that I have read and understood the
Terms and Conditions of Sylgam Travels Kenya. I herewith promise that l will abide by these Terms and
Conditions. I furthermore declare that I will always ensure that the minors under my responsibility are also
aware of these Terms and Conditions and that they abide by these Terms and Conditions at all times.
